Tripophilia – Terms & Conditions of Service & Trip Participation Agreement
This Agreement ("Agreement") is entered into by and between Tripophilia (hereinafter referred
to as “Tripophilia”), having its registered office at [Insert Registered Address], and the
Client (hereinafter referred to as the “Participant”).
By booking any trekking, mountaineering, adventure activity, or travel experience (“Trip”)
with Tripophilia, the Participant acknowledges that they have read, understood, and agreed
to the terms and conditions outlined herein. This Agreement forms a legally binding contract
between Tripophilia and the Participant.
1. Acceptance of Risk & Participant Responsibility
- The Participant acknowledges that adventure travel and trekking carry inherent risks, including but not limited to injury, illness, loss, or death caused by weather conditions, high altitudes, terrain, wildlife, and other unforeseen factors.
- Participation is voluntary, and the Participant assumes full responsibility for their safety, physical fitness, and preparedness.
- The Participant agrees to disclose all relevant medical, psychological, or physical conditions before booking.
- Tripophilia will take reasonable safety measures but cannot guarantee a risk-free experience.
2. Booking & Payments
- Booking a Trip constitutes unconditional acceptance of these Terms & Conditions.
- The Participant is responsible for verifying booking details, including trip dates and personal documentation.
- Payments must be made within the specified timeline. Late payments may result in cancellation without refund.
- Only the portion of the payment made in cash is refundable in cash. Payments made via vouchers, discounts, promotional codes, or non-cash methods are non-refundable in cash.
- Refunds, where applicable, will be processed within 15–30 working days.
- Voucher Terms:
- Non-transferable.
- Cannot be combined with other offers.
- Valid only for trips booked directly with Tripophilia in India.
- Must be used with the registered email or phone number.
3. Minor Participation Policy
- Participants under 15 years must be accompanied by a parent/legal guardian with a signed consent form.
- Participants aged 15–18 years may join solo with a signed parental disclaimer.
4. Promotional Material
Trip photographs/videos are illustrative and not part of a service guarantee.
5. Documentation & Permits
All required documents must be submitted before the trip. Tripophilia is not liable for non-performance due to incomplete/missing documents.
6. Communication
All official communication will be sent to the registered email ID.
7. Insurance
Participants are strongly advised to have comprehensive travel insurance covering high-altitude trekking, illness, evacuation, and cancellations. If the Participant does not opt for their own insurance, Tripophilia will provide default third-party insurance for Indian citizens only. Tripophilia holds no liability for claims with the insurer.
8. Amenities & Conditions
Remote trekking regions may have limited amenities. Discomfort caused by environmental or logistical factors is not the responsibility of Tripophilia.
9. Exclusions from Trip Cost
Unless otherwise stated, the trip cost excludes:
- • Travel insurance, airfares, visas, evacuation costs, excess baggage fees, personal expenses, tips, alcoholic beverages, laundry, and other personal costs.
10. Luggage & Personal Belongings
Participants are solely responsible for their belongings. Tripophilia is not liable for loss/damage/theft.
11. Optional Activities
Optional activities not included in the package are undertaken at the Participant’s own risk.
12. Force Majeure
Tripophilia is not liable for cancellations, delays, or service modifications caused by factors beyond its control, including natural disasters, political unrest, pandemics, and government restrictions.
13. Itinerary Modifications
Tripophilia reserves the right to alter, shorten, or cancel trips due to safety or operational reasons. Any additional costs incurred will be borne by the Participant.
14. Cancellations & Refunds
No refunds/vouchers will be issued for voluntary withdrawal or removal from a trip.
If Tripophilia cancels before trip start:
- Alternate trip/date will be offered.
- Credit voucher valid for 1 year.
- Option to transfer to another trip (cost differences payable).
14.3. If a trip is abandoned after starting, no refunds/vouchers will be issued.
14.4. Tripophilia is not responsible for related travel costs like flights or visas.
15. Discontinuation Conditions
Participants may be removed from a trip for:
- Severe altitude sickness or critical medical issues.
- Inability to maintain group pace.
- Possession/use of alcohol, drugs, or engaging in unsafe/offensive behavior.
No refunds or vouchers will be provided in such cases.
16. Medical Emergencies & Evacuation
All medical/evacuation costs are the Participant’s responsibility.
17. Third-Party Services
Tripophilia hires porters, guides, and other staff via third-party vendors and is not liable for their performance or conduct.
18. Photography & Media
By joining a trip, the Participant grants Tripophilia the right to use photos/videos for promotional purposes unless they opt out in writing at the time of booking.
19. Website Use
Content is subject to change without notice. Unauthorized use or reproduction is prohibited.
20. Collaboration Policy
Only approved collaborations are permitted. Tripophilia reserves the right to reject without explanation.
21. Blacklist Policy
Tripophilia may blacklist individuals for misconduct, safety violations, harassment, or defamation. No refunds will be issued.
22. Complaints & Dispute Resolution
Complaints must be submitted within 7 days of trip completion. Disputes will be resolved through arbitration in Dehradun under Indian law.
23. Governing Law
This Agreement is governed by Indian law, with exclusive jurisdiction in Dehradun, Uttarakhand.
